Offer

SAMCHUK TRADING CO. L.L.C (hereinafter referred to as the “Seller”) sets forth these terms and conditions for the remote purchase of goods via the official SAMCHUK online store at https://samchuk.store.

This document constitutes a legal offer (the “Offer”) under Article 131 of the Civil Code of the United Arab Emirates. By accepting this Offer without reservations, the Buyer enters into a binding agreement (the “Agreement”) in accordance with Article 135 of the Civil Code of the UAE. Acceptance occurs when the Buyer places an Order for the Goods listed on https://samchuk.store in compliance with the procedures outlined in this Agreement.

By placing an Order through the Online Store, the Buyer confirms their consent to all terms of this Agreement, including those governing the collection and processing of personal data of the Buyer and/or the designated Recipient. If the Buyer disagrees with any part of this Agreement, they should refrain from completing the purchase.

Terms and Definitions

Order – a properly completed request submitted by the Buyer through the Site, with all required fields in the “Shopping Cart” and “Checkout” sections filled, for the purchase and delivery of selected Goods to the address specified by the Buyer.

Buyer – an individual legally capable of entering into this Agreement, who has accepted the terms of this Offer by placing Orders and purchasing Goods from SAMCHUK via samchuk.store for personal, household, or other non-commercial purposes.

Recipient of the Order – an individual designated by the Buyer to receive the Order, for personal, household, or other non-commercial purposes.

Seller / OperatorSAMCHUK TRADING CO. L.L.C., a company registered in the United Arab Emirates, Main License No. 1105601, Register No. 1814163 421950, with the registered address: Dubai, Al Hamriya, 1004 office 08-0481. The UAE is the country of domicile of the Seller.

Site – the official online platform of the Seller, accessible at samchuk.store.

Goods – clothing, footwear, accessories, and other products presented for sale on the Site by the Seller.

Online Store – the official e-commerce platform of the Seller SAMCHUK, located at samchuk.store, where the Seller presents Goods for purchase along with the terms of payment, delivery, and other services.

Personal Data – any information relating to an identified or identifiable individual (the “Consumer”), which the Consumer voluntarily provides during Order placement or which is collected automatically through the Site (including cookies), for the purpose of executing the Order and managing the Buyer’s interaction with the Online Store.

Cookies – small data files and similar technologies used by the Site to enhance the Buyer’s experience, personalize content, remember preferences, and provide relevant information.

Delivery Service – an independent third-party organization (courier, transport company, etc.) contracted by the Seller to deliver Orders.

Seller’s Warehouse – the Seller’s storage facility located in Dubai, UAE and Moscow, Russia.

 

General Provisions

This Public Offer governs all Goods and services presented on the Site, provided that such items are described and available in the online store catalog.

The Offer is considered accepted by the Buyer once the Buyer places an Order or confirms it via the Checkout page on the Site, which becomes accessible after proceeding from the Cart section.

The Agreement concluded upon the Buyer’s acceptance of this Offer is a standard accession agreement, which the Buyer joins without any exceptions or reservations.

Orders can be placed on samchuk.store at any time, 24/7, except during periods of scheduled maintenance or technical issues.

Addresses and operating hours of pickup points (if available), as well as procedures for returns, are published on the Site in the “Shipping” and “Returns” sections.

The relationship between the Buyer and the Seller is governed by the Civil Code of the United Arab Emirates and other applicable laws and regulations of the UAE.

The Seller reserves the right to modify or supplement the terms of this Agreement by posting updates directly on the Site. The Buyer is responsible for reviewing such changes in the “Customer Service” section. Any revised version of the Agreement takes effect upon its publication on the Site and applies to all Orders placed thereafter, unless otherwise specified.

All textual content, images, and graphics of Goods displayed on the Site are the property of the Seller or its partners. Viewing or printing Site content is permitted solely for personal use.

Subject

SAMCHUK TRADING CO. L.L.C. (the “Seller”) agrees to sell the Goods displayed in the online store catalog at samchuk.store, and the Buyer agrees to accept and pay for the Goods at the prices indicated on the corresponding product page, according to the terms of this Agreement.

Placing an Order constitutes the Buyer’s full and unconditional acceptance of this Offer, including provisions related to the processing of their Personal Data.

A retail sale agreement is considered concluded from the moment the Seller issues the Buyer a sales receipt, electronic confirmation, or any other document confirming payment for the Goods.

By placing an Order, the Buyer acknowledges that the Seller may delegate the fulfillment of the Agreement to a third party, while retaining full responsibility for its proper execution. The Seller does not conduct business with, or provide services to, individuals or entities in OFAC-sanctioned or other prohibited countries.

Registration and Order Terms

Orders are placed directly by the Buyer via the Site.

All communication with the Seller’s representatives must follow principles of respect, etiquette, and professional conduct. The use of offensive language, threats, or abusive expressions in any form is strictly prohibited.

Registration on the Site is optional. If the Buyer creates an account, they are responsible for maintaining its confidentiality.

When placing an Order, the Buyer is required to provide the following information:

  • Full name of the Buyer or the Recipient of the Order (if different from the Buyer)

  • Contact details, including email address and phone number

  • Billing or settlement information (if applicable)

  • Selected delivery method

  • Delivery address

  • Payment method details (for online card payments, the Buyer must provide the relevant bank card information)

  • Gift certificate information (if applicable)

  • Any other information requested by the Seller necessary to fulfill the Order

The Seller is not liable for the accuracy or completeness of information provided by the Buyer. The Buyer bears full responsibility for any errors that prevent the Seller from properly fulfilling the Order.

If a requested item is out of stock, the Seller may remove it from the Order or cancel the Order entirely, notifying the Buyer via the email address provided. The Buyer may cancel their Order within 24 hours; refunds will be issued using the original payment method.

Product images on the Site are for illustration purposes only and may differ from the actual product. Product descriptions may contain errors or omissions. Buyers are encouraged to contact the Seller via the “Contact Us” section for clarifications.

If an Order is canceled, the Seller will refund the cost of the Goods using the same payment method initially used.

Upon placing an Order, the Buyer will receive an estimated delivery timeframe via email. The Seller reserves the right to adjust delivery dates unilaterally if necessary due to objective circumstances.

 

Order Delivery

Information on available delivery methods and estimated delivery times for products sold by SAMCHUK can be found in the “Shipping” section at samchuk.store.

Orders are delivered worldwide through courier and transport services. The delivery area generally covers all regions unless specified otherwise for certain products. In some cases, delivery zones or methods may be detailed in the product description or clarified directly with the Seller. A full list of countries where delivery is possible, along with corresponding shipping costs based on the selected method, is available in the “Shipping” section of the Site.

Delivery to certain countries may be limited due to local regulations or international agreements. If shipping is restricted, the order will be returned to the Seller, and payment will be refunded within 10 days via the original payment method.

All shipments include a return form with details on the return period and care instructions for the Goods.

For Buyers outside the United Arab Emirates, all applicable taxes and duties of the Buyer’s country are included in the shipping price.

The Seller strives to meet the estimated delivery timelines but is not responsible for delays caused by circumstances beyond its control.

Upon delivery, the Order must be handed over to the Buyer or the designated Recipient. If neither is available, the shipment may be received by a person who can provide the relevant Order details (consignment number and/or Buyer’s full name).

The risk of accidental loss or damage to the Goods passes to the Buyer upon delivery and signing of delivery confirmation documents. In the event of non-delivery, the Seller will refund the full cost of the Goods and delivery once the loss is confirmed.

Delivery costs are calculated individually based on the chosen shipping method and destination. Buyers acknowledge that delivery is a separate service and not part of the purchased Goods. Any claims regarding the quality of the Goods after receipt will be handled in accordance with applicable laws and the Seller’s warranty obligations.

The Seller’s responsibility is considered fulfilled when the Goods are delivered to the Buyer/Recipient or received at the designated postal office or pickup point.

Upon receipt, the Buyer must inspect the Goods in the presence of the courier or postal employee, checking the quantity, assortment, completeness, condition, and packaging. Any issues (shortages, wrong items, defects) must be documented in an Act of Identified Non-Conformities. Failure to do so is considered confirmation that the Goods were delivered correctly.

For returns of Goods delivered via transport companies due to defects or discrepancies, the Buyer/Recipient must include the following documents with the return:

  • Refund request form

  • Copy of the Act of Identified Non-Conformities

  • Payment receipt copy

  • Shipping inventory copy

  • Return form

  • Photos showing the defect

  • Examination report (if applicable)

Payment for Goods

The prices of products in the SAMCHUK online store are displayed in AED, EUR, USD, GBP, or another currency selected by the Buyer. Payments are made to the accounts specified by the Seller.

All prices are determined solely by the Seller and displayed on the product pages at samchuk.store. If an incorrect price is listed, the Seller will contact the Buyer to confirm the Order at the corrected price or to cancel it. If the Buyer cannot be reached, the Order is considered canceled, except when the actual price is lower than listed. Payments already made will be refunded using the original payment method; processing may take up to 45 days.

The Seller may change the prices of Goods at any time. Prices of Goods already ordered are fixed and will not change. The offer to purchase a specific product is valid while the item is available on the Site and in the Seller’s warehouse.

Buyers can make payments using the following methods:

  • SWIFT Bank Transfer

Return and Exchange of Goods and Refunds

SAMCHUK allows returns and exchanges of products under the following conditions.

Products can be exchanged within 14 days of receipt if they do not meet the Buyer’s expectations in terms of size, color, style, fit, or configuration.

Returns or exchanges are accepted only if:

  • Packaging, labels, and seals remain intact;

  • The product’s consumer properties are preserved;

  • All components are included;

  • Proof of purchase (sales receipt or electronic confirmation) is provided.

Returns of Goods in Good Condition

Buyers may cancel their order at any time before delivery. After delivery, returns are accepted within 7 days, excluding the day of receipt, provided the product maintains its presentation and consumer qualities.

Refunds for returned items will be processed within 7 days from the moment SAMCHUK receives the returned Goods, along with a completed refund request submitted by the Buyer. Shipping costs for returns are not refundable.

If a replacement product is unavailable, the Buyer can cancel the order and request a full refund using the original payment method. Refunds may take 10–45 days depending on the issuing bank.

For returns or exchanges, the Buyer must carefully repack the product with all components, accessories, the invoice, and the return form provided via email after submitting the online return request.

Refunds for Cash on Delivery (COD) orders are issued as store credit to the Buyer’s account.

Returns of Defective or Non-Conforming Goods

Defective goods are those that do not perform their intended functions or do not match the order specifications. Minor design differences do not constitute defects.

Buyers or Recipients must inspect the product upon delivery, checking completeness, condition, and packaging. Any issues with quantity, appearance, or quality must be documented in an Act of Identified Non-Conformities. Claims raised after delivery without such documentation cannot be accepted.

Refunds for defective goods are processed within 7 days from submission of the claim and are returned to the original payment method.

Returns can be made via transport companies. Full instructions and policies are available in the “Refund Policy” and “How to Make a Return” sections of the website.

Responsibility

SAMCHUK is not liable for damages resulting from misuse of purchased products. The Seller is also not responsible for inaccuracies in information provided by the Buyer when placing an order.

Personal Data

For the purposes of this Agreement, personal data includes any information that can identify an individual.

By accepting this Agreement, the Buyer consents to the collection, storage, processing, transfer, and use of personal data (both for the Buyer and the Recipient) for purposes including:

  • Processing and fulfilling orders, including status updates;

  • Compliance with legal obligations;

  • Handling inquiries, complaints, and quality checks;

  • Customer satisfaction research and analytics;

  • Organizing promotions and loyalty programs.

Personal data may be processed automatically or manually and may be shared with trusted third parties, including:

  • Shopify International Ltd., Dublin, Ireland;

  • Mindbox.Cloud B.V., Amsterdam, Netherlands;

  • Google Analytics;

  • Delivery services for order fulfillment purposes.

All partners comply with applicable personal data protection laws. Advertising messages will only be sent with explicit consent. Buyers can opt out at any time by clicking “Unsubscribe” in emails or contacting SAMCHUK Customer Service at info@samchuk.store or via WhatsApp.

Personal data is retained during the term of this Agreement and for 5 years after its termination, unless otherwise required by law. Buyers may request access, correction, blocking, or deletion of their data if it is inaccurate or unlawfully obtained.

Duration of the Offer

This Public Offer becomes effective when accepted by the Buyer and remains valid until revoked.

Additional Terms

SAMCHUK may transfer its rights and obligations under this Agreement to third parties. Temporary unavailability of the online store or services may occur due to maintenance or technical reasons.

Any disputes will first be attempted to resolve amicably; unresolved disputes will be submitted to competent judicial authorities in accordance with applicable law.

If any part of this Public Offer is declared invalid, the remaining provisions will continue in effect.
